Legal notice

1. Nature of the Service

The PERIFORMANCE website (“Website”) is an online information-sharing platform operated within the framework of the project having Grant Agreement ID: 101216808, DOI 10.3030/101216808.

The Website enables Consortium members and authorized contributors to independently publish and maintain project-related content.

Technical hosting and administration are provided by:

BBMRI-ERIC acts as Host Institution.

 

2. Role of the Host Institution

The Host Institution acts as an intermediary technical service provider within the meaning of applicable EU digital services legislation.

The Host Institution:

  • provides technical hosting infrastructure;
  • does not generally monitor transmitted or stored information;
  • does not systematically conduct prior legal or scientific review of uploaded content;
  • does not endorse third-party content solely by making it available on the Website.

The Host Institution may implement reasonable technical or administrative measures necessary to ensure the security, integrity, functionality, or legal compliance of the Website.

3. Role of Content Providers

Each Consortium member or authorized contributor publishing content on the Website acts as an independent content provider and remains solely responsible for:

  • the legality and accuracy of published content; 
  • compliance with applicable law; 
  • ensuring respect for intellectual property, confidentiality, privacy, and data protection rights. 

Contributors must not upload content that is:

  • unlawful; 
  • defamatory; 
  • discriminatory; 
  • misleading or fraudulent; 
  • infringing third-party rights; 
  • harmful to cybersecurity or system integrity. 

To the best of its knowledge and acting in good faith, each Content Provider represents that it has the necessary rights and permissions to publish the content it provides to the Website.

In the event of a third-party claim relating to content provided by a Content Provider, the Content Provider shall cooperate in good faith with the Host Institution and other affected parties in addressing the matter, within the limits of its legal capacity and internal rules.

4. No General Monitoring Obligation

The Host Institution is under no general obligation to monitor information stored or transmitted through the Website, except as required by applicable law.

5. Notice-and-Action Procedure

Any individual or entity may notify the Host Institution of allegedly unlawful content by contacting: contact@bbmri-eric.eu

The notice should contain:

  • precise identification of the content; 
  • explanation of the alleged illegality; 
  • contact details of the notifying party; 
  • a statement confirming good-faith belief in the accuracy of the notification. 

The Host Institution may:

  • request clarification; 
  • temporarily restrict access; 
  • remove content; 
  • suspend publishing privileges of repeat offenders where appropriate. 

6. Internal Handling of Complaints

Where content is removed or access restricted, the affected contributor may request review by contacting: contact@bbmri-eric.eu

The Host Institution may reinstate content where removal is determined to have been unwarranted.

 

7. Limitation of Liability

To the maximum extent permitted under applicable law, the Host Institution shall not be liable for third-party content stored or made available through the Website where:

  • it lacks actual knowledge of unlawful activity or unlawful content; and 
  • upon obtaining such knowledge, it acts expeditiously to remove or disable access where appropriate. 

8. Indemnification

Each contributor agrees to indemnify and hold harmless the Host Institution against claims, damages, liabilities, or costs arising from content published by that contributor.

9. Abuse and Misuse

The Host Institution reserves the right to suspend or terminate access for contributors who repeatedly publish unlawful or clearly abusive content.

10. Data Protection

Each Consortium member remains independently responsible for ensuring compliance with applicable data protection legislation regarding any personal data contained in content it uploads or publishes.

The Host Institution processes technical and operational data relating to the Website in accordance with the General Data Protection Regulation (GDPR) and the Website Privacy Notice.

11. Applicable Law and Jurisdiction

These Terms shall be governed by the laws of Belgium.

Any disputes arising from or in connection with these Terms shall fall within the exclusive jurisdiction of the courts of Brussels, unless mandatory law provides otherwise.

All obligations under these Terms shall apply subject to the applicable laws, privileges and immunities, internal regulations, and governing rules binding upon each participating institution

12. Special Terms

Nothing herein shall be deemed or interpreted in any way whatsoever as a waiver, express or implied, of any privileges or immunities accorded to any of the Parties by its constituent documents or international law.
